These Terms & Conditions (“Terms”) are an agreement between you and Backlot Creations, LLC (“YouThink,” “we,” “us,” or “our”) governing your use of the YouThink mobile app and website (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.

Eligibility

You must be at least 13 years old to use YouThink. By using the Service, you represent that you meet this requirement and that the information you provide is accurate.

Your account

You’re responsible for your account and for keeping access to it secure. Provide accurate information, don’t impersonate others, and don’t share your account in a way that puts it at risk. Tell us promptly if you suspect unauthorized use.

Your content

You keep ownership of the questions, answers, comments, and other content you post (“Your Content”). By posting it, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute Your Content for the purpose of operating and improving the Service. You represent that you have the rights to post Your Content and that it doesn’t violate these Terms or any law.

Acceptable use

These rules carry forward the spirit of the original YouThink Rules of Conduct. You agree not to:

• Post content that is illegal, infringing, or violates someone else’s rights.
• Harass, bully, threaten, or attack others — including attacks based on race, gender, sexuality, religion, or disability.
• Post the private information of others (such as full names, addresses, or phone numbers), or repost someone’s private messages.
• Impersonate anyone, or create accounts to deceive, evade a ban, or attack others.
• Spam, advertise, or flood the Service with disruptive or repetitive content.
• Distribute malware, attempt to gain unauthorized access, or otherwise disrupt or interfere with the Service.
• Scrape or harvest data from the Service except as we expressly permit.
• Let anyone use your account to get around a suspension or ban.

Content standards

Keep it appropriate for an audience aged 13 and up. The following are not allowed in profiles, photos, comments, or posts:

• Nudity, sexually explicit imagery, or graphic depictions of sexual acts.
• Pornography, or links to pornography.
• Graphic violence, or imagery likely to shock or offend.
• Hate symbols or imagery, such as swastikas or other racist content.
• Glorification or depiction of illegal drug use.
• Text that goes beyond a PG-13 standard for sexual content.

Protecting younger users

YouThink has users between the ages of 13 and 17, and we take their safety seriously. Sexual advances toward minors — in public or in private — are strictly prohibited and result in immediate, permanent removal, and we may report them to the authorities. Never direct explicit content or comments to anyone you know or believe to be a minor.

Objectionable content, reporting, and blocking

We have zero tolerance for objectionable content and abusive behavior. If you see content or a user that violates these Terms, you can report it or block the user from within the app, or email hello@youthink.com. We review reports and act on objectionable content — which may include removing it and removing the responsible user — promptly, typically within 24 hours.

Moderation and enforcement

We may review, moderate, remove, or restrict content, and suspend or terminate accounts, at our discretion — for example, to enforce these Terms or to protect the Service and its users. We aren’t obligated to monitor all content, but we may.

Depending on the severity, enforcement may range from a warning, to a temporary suspension, to permanent removal. Serious violations — such as those involving the safety of minors, pornography, or attempts to compromise the Service — may result in immediate permanent removal without warning.

Our intellectual property

The Service itself — including the YouThink name, logo, software, and design — belongs to us and is protected by intellectual-property laws. These Terms don’t grant you any right to use our branding without our permission.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. Content posted by users is their own; we don’t endorse it and aren’t responsible for it.

Limitation of liability

To the fullest extent permitted by law, YouThink and Backlot Creations, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the Service.

Indemnification

You agree to indemnify and hold harmless YouThink and Backlot Creations, LLC from claims arising out of Your Content or your violation of these Terms or any law.

Termination

You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we’ll update the date above and, where appropriate, notify you in the app. Continuing to use the Service after changes take effect means you accept the updated Terms.
