The woman in this case, who cannot be named, had been married to her husband for more than eight years before he died. A 1998 Supreme Court ruling allowed her to have his sperm taken and stored at the Royal Women's Hospital. But Justice Hargrave ruled today the Infertility Treatment Act banned the proposed procedure unless written consent had been given by her late husband before his death.
