A motorist fell asleep at the wheel of his car, and ended up going down an embankment onto a railway line. An oncoming train hit the car and killed 4 people. The driver of the car has got 5 years in jail (an affair with his wife was the reason for him being too tired to drive). The insurance company is now fighting a legal battle to get out of paying the £50,000,000 bill, as they claim that the highways department is to blame for not having adequate crash barriers to prevent the car from ending up on the railway line. Who should pick up the bill?
