CARLISLE, Pa. -- The state Supreme Court has rejected an emergency petition to release a pregnant murder suspect on grounds that imprisonment violates the constitutional rights of her unborn child. Candice Staruh, 22, of North Newton Township, has been held in the Cumberland County Prison since last fall. She is charged with first-degree murder in the October 2003 beating death of her 3-year-old son, Jordan Jackson. Staruh is expecting a child in April. Her attorney, Karl Rominger, argued that the state Abortion Control Act states that the unborn deserve equal protection under the law. He also argued that the jail environment wasn't healthy for Staruh's unborn child and that imprisonment illegally deprived the child of liberty.
