Does modern society take Hammurabi's saying out of context?

The saying is the famous, 'an eye for an eye, a tooth for a tooth', and most people use this as a way of justifying revenge, but it was actually meant to explain the principle of equal response. For example, during Hammurabi's time, if someone killed your brother, it would've been appropriate to kill the brother of the murderer, rather then the murderer himself.
