Except for emergencies, is it acceptable for a restaurant to close prior to their posted closing hours?

There is a "BBQ" joint in Sunnyvale, Kal's BBQ with posted closing hours of 9 PM... but by 8 they always close, and they have kicked me and a date out at about 8 as well.
