Is the United States continued use of the death penalty unlawful?

The International Bill of Human Rights includes the International Covenant on Civil and Political Rights. Article 6 (paragraph 1) of that covenant states, 'Every human being has the inherent right to life. This right shall be protected by law. No one shall be arbitrarily deprived of his life.' The USA ratified this agreement in September 1992.
