If you were a judge, who would you side with in this lawsuit: Bonzi or the people representing Internet users?

Suit alleges deceptive Internet advertising banners By John K. Wiley, Associated Press SPOKANE — A law firm has sued a California software manufacturer for fraud, alleging that Internet advertising banners that impersonate computer error messages are deceptive. The complaint contends Bonzi Software Inc. 'commandeered' tens of millions of computer users to its commercial web site. Bonzi is believed to have issued more than 300 million of the banner ads. The banners have headings that read “Security Alert,” “Warning” and “Message Alert” with such messages as: “Your computer is currently broadcasting an Internet IP address. With this address, someone can immediately begin attacking your computer.” Viewers who click an “OK” button are sent to a commercial web site promoting Bonzi software for preventing Internet intrusions or speeding up Internet connections....
