Do you think that the current legal system should (/would) still be applied if it were believed that free will did not exist?

Both legally and morally, we assume that individuals are accountable for choices/actions they make. Is this assumption necessary for the Western legal system to work as it does, or would similar approaches to punishment/imprisonment/rehabilitation be appropriate regardless? If not, what should be done otherwise?
