While the appointment of Senator Hillary Clinton to Secretary of State appears to be an all but done deal, there are some legal scholars who believe that the move would be unconstitutional.

"Why? Because the Constitution forbids the appointment of members of Congress to administration jobs if the salary of the job they'd take was raised while they were in Congress," NBC's Pete Williams reports.

Article I, Section 6: "No Senator or Representative shall, during the Time for which he was elected, be appointed to any civil Office under the Authority of the United States which shall have been created, or the Emoluments whereof shall have been increased during such time; and no Person holding any Office under the United States, shall be a Member of either House during his Continuance in Office."

If the scholars are correct, and it would indeed be unconstitutional, then she shouldn't be able to.

It is unconstitutional. I have nothing against Hillary Clinton, but it's right there. However, I don't think this should be taken to court. People should just live and live on things like this. The intention of this section of the Constitution was obviously to prevent congressmen/senators from raising the salary of a civil service position they were about to take. This does not apply in this case. Hillary was aspiring to be president, so if she voted to raise the salary of secretary of state, she wasn't doing it for her own personal benefit.

It's unconstitutional. However she is not breaking the law yet. She still has to have approval of congress and has time to step down from her Senator position as her official position would not take effect until Jan 17, 2009. I'm wondering if she's wise enough to do that and why she hasn't is probably she wanted to ensure her position first before stepping down.
