in what way is it a pie? the base is shortbread, not pastry, it has no crust on the top, and is full of a thick gooey cakey stuff, therefore cake.

There is nothing "cakey" whatsoever about the interior, and plenty of pies do not have a top crust (meringues, pumpkin, etc).

It depends on the type of cheesecake. French style is more pie or pudding like. New York style (what most Americans think of when you say cheesecake) is more cake like. It really doesn't matter because cheesecake is delicious.
