Should police have the power to confiscate motorists` phones?

Um, sure. Maybe if people had to go through a lot of hassle to get their phones back, they would stop talking while driving.

If they had evidence that the person was using their phone to do anything illegal, then yes. I don't believe they should just take the phone away without good reason to though.

In my state it's illegal to talk on your cell and drive, and most people just ignore the law. If the police confiscated their phones when cought using them while driving, maybe they'd take the law a little more seriously.

It's all fine and dandy to harp on about not talking on your phone whilst driving etc, but if they took some action, such as confiscating phones, then they might get the message across. But that is a bit harsh.

Confiscating the phone is just a big hassle for everyone. I think a fine gets the point across just as well. (It's illegal here to talk on a mobile and drive, unless you have a hands free thing)

I don't think they should take them... people just need how to use these wierd things designed to place in your ear so you don't have to hold your phone, oh i think it's called an earpiece or something. I'm not sure on this one though but i think ground breaking information may be avalible on wikipedia

They should just take the Sim card, the rest of it is easily replacable. Having to tell everyone their new phone number would be a hassle.

No, they shouldn't be able to confiscate a phone. What if something happens to a driver like an accident on an empty and deserted road and having to call for help?

They can confiscate other things you've legally purchased if they are being misused. Surely phones could fall under the same umbrella.

No. Taking the phone is a bit harsh. If it's illegal, a fine should do.

I don't see why not. There's no excuse for knowing it's illegal to drive and talk on the phone. A fine isn't much of a deterrant for many people, the chances of actually getting caught are pretty low.

Having your phone taken off of you will really make you think twice.
