Worker advocates reported scattered firings around the country related to Monday's marches that drew hundreds of thousands of demonstrators, including an estimated 400,000 in downtown Chicago. 'By far the vast majority of employers respected workers' right to take the day off, but there some instances of workers getting fired,' Tim Bell, executive director of the Chicago Workers' Collaborative, said. 

The group is a member of the ad hoc National Workers Defense Committee, which is coordinating a response with legal help from the Service Employees International Union. The group said it is preparing to file a single national unfair labor practice charge against employers who violated workers' rights. Such demonstrations are largely protected by the National Labor Relations Act, and employers are not allowed to impose penalties for absences for rallies that they don't impose for other types of absences.

Should workers be fired if they skipped work on May 1 for the immigration rallies?

I would think an employer would have a hard time justifying firing them for taking that day off if they followed company guidelines for taking a day off of work or if the consequences for missing any other day of work would not have such harsh consequences.

if there is a policy in the company that says an employee can just NOT show up...or can give notice that he/she will not be there that day--fine, take a holiday...

Otherwise, penalize their butts.
They made a choice...suffer the consequences...
THAT, dear friends, is what its all about, isn't it?
Break a law, suffer the consequences...

pretty simple and universal rule, must be applied fairly...no?

Many of them are legal residents, legally employed. Many are US citizens, born and raised here.

All of our hispanic workers took the day off, and they are all US citizens, with every right to be here and to work here.

And, no, I don't think they should be fired, especially if they asked for the day off beforehand.
