Georgia legislator seeks to give unborn babies right to jury trial
December 9, 2002
By Felicia Dionisio, WorldNetDaily.com

Georgia legislators will introduce a bill early next month that refers to abortion as an 'execution' and will require any mother seeking an abortion to go to court to obtain a death warrant.

'A mother would have to argue why the child should die and why her rights would take priority over the rights of the child,' said Rep. Bobby Franklin, R-Marietta, who sponsored the legislation.

Once a mother filed for a death warrant, a guardian would be appointed to protect the rights of the unborn child. That guardian would be authorized to demand a jury trial in which the rights of the unborn child would be balanced against the rights of the mother seeking to have the 'execution' performed....

Should this law in Georgia be passed, making it illegal to get an abortion without a `death warrant` from a judge?

That's kind of cool.. I hope they tell every mother no.

Me too Matt. I think it will at least make selfish, heartless women think twice before they murder their own flesh and blood. If they have to get a death warrant in order to 'execute' their child, maybe it will make some think twice and some lives will be saved. I'd like if they did this in every state!

I don't get it. It doesn't have legal documentation that it's alive, so why should it have legal documentation that it's now dead? I think it would be far more humane for anyone who wanted a child to first have to go to court and prove that they'll be able to support it.

I have to agree with rufio, its legaly impossible, since the individual is not legaly alive... currently there no no rights for the unborn...
19 yrs ago, 5 mos ago - Monday 12/16/02 - 11:23:40 AM EST (GMT-5)
It wouldn't survuve any judicial review, and I'm sure it would be challenged immediately.

Next women will have to get a warrant every time the menstruate, explaining why it was that they chose not to get pregnant and wasted an egg.

yep, go Georgia
19 yrs ago, 5 mos ago - Monday 12/16/02 - 2:23:16 PM EST (GMT-5)
I think that is a sick bit of legislation. It is a womans choice if she wants the child or not. An unwanted child is gonna have a poo life any way. What about women who have been raped? Should they be made to have a child who will be a constant reminder of what happened to them?
19 yrs ago, 5 mos ago - Monday 12/16/02 - 2:23:43 PM EST (GMT-5)
I don't get it either, rufio. First you're born, then you live, then you die. To prove that you have died, you get a death warrant. What about women who miscarry? Will they need to get a death warrant in Georgia?
19 yrs ago, 5 mos ago - Monday 12/16/02 - 2:41:57 PM EST (GMT-5)
Gilly, I'm sure most people would rather have a crap life than no life at all. If the mother feels it would have a bad life, the best thing is to give it up for adoption to people who DO want it, and want to give it the best life possible.
19 yrs ago, 5 mos ago - Monday 12/16/02 - 4:40:01 PM EST (GMT-5)
And there are plenty of people who commit suicide and/or become serial killers.
19 yrs ago, 5 mos ago - Monday 12/16/02 - 4:49:16 PM EST (GMT-5)
id have to say no, its not a good idea.and im strongly pro-life. if you are gonna say it has rights to the deat warrant, but is not really alive, its pretty hypocritical. and if they were to say it is alive and has rights, but can still be executed, its admitting murder
19 yrs ago, 5 mos ago - Monday 12/16/02 - 5:25:11 PM EST (GMT-5)
That is ridiculous. And at least for now unconstitutional. I'm so tired of adoption being the reason women shouldn't have abortions. There are so many children that have already been born that need homes. The loving couples 'waiting' for a baby are only waiting for white babies. Can you imagine the reality of the amount of babies that would be born every year if women weren't allowed to have abortions? I'm not saying adoption shouldn't exist, there are many women who really don't want to have abortions. Adoption is an option. But it's not the only option.

^can you imagine the amount of kids being born if there wasnt war? we are so lucky to have countries dropping bombs on each other. and by the way, of all the people i know who have adopted they have either been asian, black, or mixed race.
19 yrs ago, 5 mos ago - Monday 12/16/02 - 6:28:22 PM EST (GMT-5)
Way to tie up the legal system and waste our tax dollars.
19 yrs ago, 5 mos ago - Monday 12/16/02 - 6:51:26 PM EST (GMT-5)
Pferde that's definitely not true. The two couples I know who have adopted were both white people with black babies. How can you say people only want white babies?
19 yrs ago, 5 mos ago - Monday 12/16/02 - 8:16:01 PM EST (GMT-5)
No, pferde, they're waiting for pro-life babies.
19 yrs ago, 5 mos ago - Monday 12/16/02 - 8:43:10 PM EST (GMT-5)
Pro life babies?? That doesn't even make sense. :P
19 yrs ago, 5 mos ago - Monday 12/16/02 - 9:31:39 PM EST (GMT-5)
Well, since babies are fully developed humans inside the womb and everyting, they should already have formed their own opinions and stuff.
19 yrs ago, 5 mos ago - Monday 12/16/02 - 9:40:44 PM EST (GMT-5)
Ooh you are just being silly now :P
19 yrs ago, 5 mos ago - Monday 12/16/02 - 9:54:15 PM EST (GMT-5)
Kiki...not nearly as silly (or should I say, insane) as the legislators in Georgia!! I am so glad not to live anywhere near there. Who elects nutcases like this???
19 yrs ago, 5 mos ago - Tuesday 12/17/02 - 1:11:14 AM EST (GMT-5)
Well, it's one step in the right direction.
19 yrs ago, 5 mos ago - Tuesday 12/17/02 - 2:08:28 AM EST (GMT-5)
It's about time somebody spoke up for the one party in the whole procedure that has no voice whatsoever, and yet whom it affects most.
19 yrs ago, 5 mos ago - Tuesday 12/17/02 - 2:09:51 AM EST (GMT-5)
what a stupid idea! the ball of cells is not yet "a" human, and thus has no rights.
19 yrs ago, 5 mos ago - Tuesday 12/17/02 - 3:21:37 AM EST (GMT-5)
Whats next compulsory unprotected sex for all fertile women? All the unwanted babies can then be sent to special military schools and used as new world order stromtroopers.
