A transgender truck driver who underwent sex reassignment surgery last year learned he could not legally change the sex listed on his birth certificate in a Pennsylvania court.
Daniel Gryphon MacNeal, formerly Ellen Bernadine Thompson, went before Judge Thomas Ling in Bedford, Penn., on Thursday to seek approval in legally becoming a man in order to update his birth certificate and other legal documents, like his driver`s license and passport. Judge Ling told MacNeal he didn`t have the authorization to grant the request.
`Gender is based on the number of matched genes and chromosomes. Sex organs are secondary,` Ling said in an AP report. `I would have to be presented with a blood test showing the gender.`
The process to change gender identification on a birth certificate varies from state to state, and almost all 50 states in the nation make it a fairly easy process for people who`ve undergone a sex reassignment surgery to obtain a new birth certificate, according to Shannon Minter, legal director for the National Center for Lesbian Rights and who also sits on the board of the Transgender Law & Policy Institute. The only three states that don`t permit people to legally change their gender identity are Tennessee, Ohio and Idaho....
No. What if his remains need an ID. The medical examiner will see female remains but. Maybe they should have a special document that says was Michael but now Michelle.
i dont know much about this but like Vixen911 says what about ID etc.
maybe on Passport, Drivers Licence etc but i think it should say somewhere what you were born as.
Vixen, that doesn't matter. If you get to the point of finding "remains", there usually ins't enough left to ID anything down there. Also, everything in men is different than in women, bone structure, shape, everything. Not to mention DNA.
But what a waste of time. These ass holes are wasting my tax dollars because they want to change their BIRTH CERTIFICATE? WHO THE fudge IS EVER GOING TO LOOK AT YOUR BIRTH CERTIFICATE??? And the way you were born is the way you were born.

no,what goes on ur birth certificate is what u are when u were born,u were male when u were born so it doesnt matter what u are now.just because u had a sex change doesnt change what u were when u were born
not a birth certificate.... i think the name of the document implies what it is - a record of what/who you were born as. i don't even think you should be able to change your name on your birth certificate... any changes should be a separate document detailing who you were, and who you are now... otherwise it wouldn't be a "birth" certificate, it would just be a constantly updated identifcation document.
I aggree with shade and Morgue! They should be allowed to change their gender on things like drivers liscences but as Richa said, the borth certificate should stay the same as it is a certificate about the birth not what happens later on.
Birth certificates should not be subject to revisionist history. There should be an adendum or something updating the gender, just like a marriage certificate updates a person's name.
