This is probably one of those things that varies by state.

I don't think you "apply" for divorce.
I think you FILE for divorce!

I know a couple who did their own divorce and they even owned a home together and had a child together. No attorney. They still work together at the same company and they are still friends.

Oh, you don't necessarily HAVE to. I didn't really hire a lawyer. I went to Legal Aid and yes, a lawyer did draw up the papers, but that's all there was. And at the time I couldn't even afford the $75 fee which I didn't really need, anyway. They only needed that if they were going to have a sheriff deliver the papers, but my ex's public defender said I could just have the papers sent to him and he'd take care of it. I also know someone from my divorce support group who left the house with her husband married to him, went to City Hall together and returned home divorced. If there's not going to be a huge battle over assets and custody of kids and they're able to settle everything with no hassle, then all they really need to do is sign some papers. Having a pre-nup kind of deflects hassles. But if there's no pre-nup, and things are already ugly, better lawyer up. Better Call Saul!

Bookworm, unless I'm seriously misremembering some stuff about you, your case was also an EXTREME outlier, legally speaking. I wouldn't assume that what happened with you was translatable to basically anyone else's situation.

I said it depends on the situation. And if you read the whole thing, I also mentioned someone else I knew that simply went to City Hall and came home and within the span of about a half hour, they were divorced. And her husband wasn't doing anything like my ex. They simply weren't happy together anymore.

I did read the whole thing. Just being able to go to the courthouse and come home divorced in half an hour without having done anything beforehand is not at all common, either.

depends if it's an amicable split or not. i don't really see the point of hiring a lawyer if you agree to separate on good terms. but i don't know how commonplace that is. people like to draw the lawyer card for any perceived slights.

if either party was abusive or something, then i'd get a lawyer.

That's kind of what I was saying. Unfortunately, in most cases, divorces aren't very amicable. My mom doesn't even understand the concept of an amicable divorce. She thinks that if you can stay on good terms, you can stay married. But I get it.
