Unless there is some crazy sci-fi tech we do not know about, mind reading is impossible, and even then thinking about it should not be a crime because that is plain silly. I have thought of how to rebel against the US so many times I would be arrested and killed via firing squad for treason if they could convict someone because of thoughts.

I've thought about doing many illegal things. Lots of people do. But I didn't because I have common sense and realized it wasn't a good idea. Minority Report is a perfect movie to watch for this question though. Only in the movie they proved people would kill, they didn't just say it while mad.
