well.. thats a tough one. I don't believe there is such a thing as temporary insanity.. insanity is a condition that generally lasts with the duration of a psychological illness... generally takes therapy, time and medicine to heal people of psych. disorders / illness, if not just help them cope. so I don;t think its right to claim temporary insanity.. just another loophole in the Justice System.

There is such thing as temporary insanity, but defense lawyers tend to use it as a lame excuse for freedom.

Actually, there's a big difference between LEGAL insanity and psychological insanity. If someone just kirks out & stabs someone in the head & doesn't care, that's insane behavior, but it's not legal temporary insanity. However, if someone BLACKS OUT and stabs someone in the head, that's legal temporary insanity, cause the person didn't know what they were doing. Temporary insanity is one of the hardest defenses to use, as one must be able to prove in court that there was either A) a history of such actions (probably on a lesser scale though) or B) a history of events that were so traumatic that the defendant was forced into that situation.

I believe that anyone that murders another human being is insane at the time, and thus it should not be used as an excuse.

I don't feel it is right to use as an excuse, even if someone is insane they still murdered a person and should still be punished for it. Also, with all the people who claim temporary insanity i think we should really question society and wonder wat is happenin to our kids

No in fact I think that such pleas should lead to a verdict of guilty by reason of insanity. You are insane, therefore you are guilty because you are more likely to do it again and should not be out free.

The temporary insanity defence found precedence in the case of an epileptic man who killed someone during a fit. That is a good reason, unfortunately , like most legal defences, it has been abused....
