So you all know me by now... I'm just that. Happy guy... Who's never sad... ever... Always smiling and saying stupid stuff... That's clarency....

Ok.

So my parents died when I was younger (Dad - 8, Mum - 10) and their entire estate was left to me and my sister. We didn't have any family left in our town so we had to move to Sydney with my Aunt and Uncle as guardians. Now we kept on going blah blah blah until one day when I was 18 driving home with my Aunt. I mentioned the money to which her response was:

"oh... no, that money. There's not much of that left. We've been using it to take care of you while you've been here".

Tuesday 11/3/09 - 6:26:51 PM
Now she's been receiving money from the government to take care of us. I don't know how much money we're talking about her (she refuses to tell either of us) but money from my parents savings, cars, house, and stocks is quite a large amount. And now it's all gone...

My sister has plans to sit down with her (with a lawyer) and discuss exactly what she did with it. She's very upset not only that she spent it... but that she didn't tell us about it till 8-9 years later...

What to do...

I would definitely bring forth legal action towards her. That money was left for YOU and not for her. She sounds like a greedy bitch. I would say make her show proof that all that money was put towards you kids and not towards herself.

Doesn't sound like a fun position It can't be easy having to basically accuse your aunt of embezzling your inheritance.
I hope it all goes well anyway
Tuesday 11/3/09 - 6:33:18 PM
Sue the bitch.

To be perfectly straight.... my Aunt is really.... really.... terrible with money. I don't know if she's the selfish type but I can see her bending logic abit to use it to get her out of a bit of debt.

That's the plan really... My sis wants to get her to show proof of every cent that she spent. The problem is that she can't do it until I leave. I still live here

If things go ugly its I'm going to very akward. I need to leave soon.

I see myself getting kicked out as soon as the lawyer knocks on the door.

most likely... yes...
Tuesday 11/3/09 - 6:36:25 PM
Will she be able to provide proof though? It's going back a fair way
Tuesday 11/3/09 - 6:48:45 PM
If I was a guardian of someone and had plans to spend their inheritance without their knowledge, and didn't want to get sued for it in the future... I'd keep receipts. Every one of them.

The car I have was bought with that money. Which I'm perfectly fine with. But the fact is that is the ONLY thing that I knew had been bought with that money until it was all already gone.
Tuesday 11/3/09 - 6:52:14 PM
I know that she should have reciepts, but if she's bad with money, then maybe she doesn't have those receipts.
Though then I guess that's what the suing bit is for..
Tuesday 11/3/09 - 6:52:58 PM
Was it willed that it was only for the next of kin?
Tuesday 11/3/09 - 6:52:58 PM
Keep us posted, I would really like to know how this comes out
Tuesday 11/3/09 - 6:53:31 PM
In New York, I'm pretty sure that'd get you thrown in jail unless you could justify every cent spent.

How much money did she spend?
Tuesday 11/3/09 - 6:56:45 PM
I suppose she couldn't really have spent all of it on you kids - not a whole estate! Not when she has another income to use to support you.
I guess she's got some explaining to do
Tuesday 11/3/09 - 7:00:07 PM
for - huh?

blu - I can see this being a series of journals... I'm hoping they see the lawyer and crap their pants and settle quickly. I don't really want to go to court.

emo - She didn't tell me how much there was at the beginning.. she didn't tell me how much there was when she told me she was spending it,... and she won't tell me now.
Tuesday 11/3/09 - 7:01:01 PM
you need to find out how much there was and where it all went.
Tuesday 11/3/09 - 7:01:55 PM
Do you have access to the account know? Can you go and see the solicitors in charge and ask them how much there was/is?

That's what i mean though. When she first told me she was spending it on everyday expenses etc... my first reaction was:

1 - You're my guardian. You chose to take this responsibility... If you aren't financially equipped to raise me then don't take it on. (there we're several options for people to take care of us, including a very close friend whos mum was prepared to adopt me at 14... if I had known she was spending my money then I would have gone in a gunshot).

and that was BEFORE I found out she had been receivign money from the government.

maybe you should just get a job and forget about it

I got control the stocks at 21 (which is f*cking sh*t coz at 20 the market went down and I lost about 15-17 grand)... My Aunt couldn't touch the stocks so we got that. Everything else I didn't hear of.... and still haven't heard of. She knows the names of who to contact and everything like that.

We were raised almost entirely on govt money plus the occasional boost from when Dad had a job. I know Sydney's probably a little more expensive, but I don't think she can justify spending all that money.
Unless it was seriously less then what would expect it to have been

I actually have 2 jobs... I just finished a 4 year degree and I'm about to start another so I can travel to the US. The money that was left for me really would be helping right about now.

money's always helpful
