A majority in Brazil's Supreme Court has voted in favour of making homophobia and transphobia crimes.

Six out of 11 judges voted to consider discrimination against gays and transgender people equivalent to racism.

The decision will give the community, which suffers constant attacks, real protection, activists say.

At least 141 LGBT people have been killed in Brazil this year, according to rights group Grupo Gay da Bahia.

The Catholic Church and the evangelical movement are frequently critical of gay rights and far-right President Jair Bolsonaro, elected last year with strong support of conservative voters, is a self-described homophobe.

When people are threaten, beaten or killed, it goes further than thoughts.

This is essentially the equivalent of hate crime legislation here. Not criminalizing thought, but allowing for additional prosecution for crimes committed against LGBTQ people.

Violent crimes against people because of sexuality and gender identity are a big problem in Brazil, and that idiot Bolsonaro hasn't helped. "I'd rather have a dead son than a gay son" is not the rhetoric you want from your president.

I guess the way i read it, 'homophobia' is a thought.

Assaulting, beating, and/or killing people would be the criminal act...

...not all homophobes or transphobes seek to attack or physically harm gay people.

You could try reading the actual article.

“The decision at the Supreme Court means that offences are to be punished under the country's racism law until Congress approves specific legislation to protect LGBT people, our correspondent adds.”

That really doesn't add much clarity, other than maybe uttering the N-word can get one arrested there...

kind of wondering where they'll draw the line. would bolsonaro go to jail for what he said? or does one actually have to commit violent acts?

If only there was some body of knowledge, like a network, that someone could access to look up Brazilian racism laws. Oh well, until there is the only sensible thing is to assume that Brazil is attempting to prosecute thoughts.

So feel free to blame me rather than the stupid reporting that fails to explain what's really going on.

God you’re useless.

It’s not the BBC’s fault that you wrote yourself a whole novel about thought police rather than taking a few minutes to research Brazilian anti-racism laws.

Sorry, I thought that professional journalists would actually provide information in a clear and complete manner...

It’s a local correspondent.

Article will be surely updated.

Also: Last year, 420 LGBT people were killed across Brazil, one of the most violent countries in the world, according to Grupo Gay da Bahia.
Some activists have raised concerns over the possibility of a rise in crimes against gays and transgender people with the election of Mr Bolsonaro, a deeply divisive figure who has also made racist and misogynist remarks.

I think the law was definitely necessary.

If the LGTBQ people would only become Nazis then CD would defend their right to not get violently attacked.

STFU.

Everyone has the right to not get violently attacked.

Hence this and other hate crime legislation.
Now wasn't that easy?
24 days ago - Saturday 5/25/19 - 5:46:12 PM EST (GMT-5)
Sure...

...but it's already illegal to violently attack people.

...and my issue isn't so much with the law, it's with the quality of the news reporting.

I was thinking the same thing. Attacking people and murdering people is already illegal. Not sure why this new law is necessary.

Motive

From what I read, the court voted it was unconstitutional to exclude sexual orientation and gender from its anti-discrimination law. This will make sexual orientation and gender crimes punishable under the anti-racism law which has stronger penalties.
