A bruising battle over the court’s latest appointee and a recent health scare involving the oldest justice has renewed interest in the age-old debate over whether there should be term limits for the Supreme Court.

It’s an idea that’s been floated before, but senators on both sides of the aisle now say it’s one that’s worth discussing in public.

“I would sure love to have the debate,” Sen. John Kennedy (R-La.), 67, told The Hill last week. “I don’t know exactly how I would come down, but it’s certainly worth talking about.”

Fellow Judiciary Committee member Sen. Richard Blumenthal (D-Conn.), 72, said he’s intrigued by the idea.

“The institutional stalwart inside me says no way, but, you know, we’re living in a different world, literally, than the Framers ever envisioned and maybe we need to think about it,” he said. “I haven’t reached any conclusions yet.”

I'm afraid we will run out of qualified candidates quickly. Even if someone is fully qualified, they wouldn't want to go through all the public scrutiny and put their families through hell, just in case someone digs up some skeleton in their closet such as some ugly or embarrassing thing they wrote in a high school yearbook 50 years ago.

There's nothing wrong with someone who wants to retire from the bench. Even forced retirement would be a good idea if it is determined they are no longer capable of doing their job due to memory loss or health issues.

As a citizen I'd like to have the most qualified people doing such a job. That does include experience but it also means that I don't want some senile, demented old fart rule over the most important issues of our time. I think judges of any kind should retire like everybody elde. One can discuss the age of retirement but lifetime doesn't make sense to me.

I know I shouldn't be surprised that noldor's response is basically "I don't think there are enough qualified people who won't be credibly accused of sexual assault so we need to keep lifetime appointments or we'll run out of qualified nominees" but somehow I am.

I mean at least he consistently manages to find the dumbest possible take on every issue.

I mean we didn't have presidential term limits until well into the 20th century. What we had instead was a norm that started with Jefferson where no president would run for a third term. And no one did until Teddy Roosevelt, who almost got assassinated over it.

Norms are great until you get some asshole coming along who just doesn't care about them. See also: 2016-2018.

If people want to vote for "some asshole" why shouldn't they? Otherwise they get another asshole that nobody wants to vote for but they vote for them anyway because they other side have another asshole they don't want to vote for either. See every US election in living memory.

I think it's a little silly to compare the literal most powerful person in the entire country to just any job. Concerns about the consolidation of power are valid in the case of chief executives.

You are comparing the literal most powerful person in the entire country. I am speaking generally. But in that case doesn't it make sense to have the best man for the job as the literal most powerful person in the country? It just adds to the dog and pony show if someone of 42 gets elected as president and he has to retire at 50. Our youngest Prime Minister was 24. He governed for a total of 18 years.

I'm referring to your "are there term limits on jobs" comment. It's a silly thing to bring up, because being president simply isn't comparable to other jobs.

Again, the rest of your response ignores the very real and valid concern about consolidating that much power into one single person for that long.

you keep talking about the President. The subject is the supreme court.

In any case paranoia is no reason to disqualify the best person for the job. If someone appears to be consolidating that much power. They can just be voted out. It happened to Margaret Thatcher and not by the public either. Her own party dealt with it.

I'm not sure I'd agree with the absolute but I certainly think that being in such a powerful positionfor too long will not improve most leaders' performance. People seem to somehow lose touch with reality over time.

what number of years would you consider to be acceptable term limits? i know the US has settled on 8 years for president, but i don't think that's everyone's idea of what is considered an acceptable term limit.

I'm against SCOTUS term limits because of how our modern political system works.

Can you imagine setting, say, an 18 year term for justices (this is a length I've heard suggested by some proponents), and then a young person serves, retires, and...does what? Well if they're anything like congressmen, they'd get some sort of lobbying-type position.
When you're talking one person out of 535 who stand for election on a 2-year or 6-year basis, that's one thing. But one of just nine people who have the final say on judicial matters? The possibility for corruption is immense.
