I'm not sure on all the legal questions and it isn't really my concern whether it's technically legal or not, tbh. I think it's an incredibly dangerous precedent to set even if it's 100% legally fine.

Although I assume the 2001 AUMF is what they'd use to justify calling him an "enemy" and I'm not sure how that flies, considering he doesn't seem to have any connection to any country that would be covered by that. I imagine that would get challenged in courts.

It was so strange flying out the night before this happened. I can't imagine still being in NYC today and having to deal with that
It was terrifyingly real, and I wasn't even there. Can't imagine what the city is going through right now

I think post 9/11 America has become desensitized to a lot of things, between that and the growing partisan device we are quicker to jump to politics than reflect on things.

I just want pre 911 airports back. What a drating hassle

Prior to 9/11 how many planes were hijacked and used as flying bombs?

In the 70’s hijackings in the US spiked but were usually used as escape plans.

Granted in the last 16 years we haven’t had a US based hijacking. I wonder how much of that is due to investigations into potential plots vs stopped specifically by TSA.

I think we should at least explore more technological solutions that are less disruptive. More plain clothes officers observing behavior.

I know what I want isn’t realistic in today’s climate, dosen’t mean I don’t want it any less.

That's a good question. The war on terrorism doesn't fall into the traditional country vs country structure of previous wars, but there is an established and organized group for which this guy admittedly was fighting, targeting the US.

What exactly is the danger of the precedent? The guy is still a foreign national and not a US citizen, and the guy freely admitted that he was acting on behalf of an organized group fighting against the US and their interests.

Non-citizens who commit crimes within the US have the same rights (due process, speedy trial, etc.) as citizens.

Source please, for being allowed to suspend due process for federal terrorism charges where the suspect is a US resident and the offense occurred in the US.

You might want to re-familiarize yourself with the concept of due process. It's a lot more than just not hanging someone in the town square like a common mob.

I've already said it several times? Indefinite detention without trial is what will happen. Just look at who's there right now, how long they've been there, and how long they've gone without ever seeing a judge (or a lawyer).

We've been detaining people at Guantanamo for over 15 years now. If you don't know by this point, you have to really not WANT to know.

Hey, you're the one who said it.

And again: if you don't know what happens at Guantanamo by now, you just don't want to know. The commission that hears cases there does not follow the same procedures as either the regular court system, or military tribunals. It is an ad hoc system where detainees aren't even allowed to see all the evidence against them. They don't have their choice of attorneys. And even if they're cleared of charges, there's no guarantee of release.
