"Two NYPD officers have been accused of raping a handcuffed 18-year-old woman inside their police vehicle in a Brooklyn parking lot, a source familiar with the case told News 4.

The two officers, Eddie Martins and Richard Hall, were indicted on charges of first-degree rape and bribe receiving and are expected to surrender to authorities on Monday, according to the source.

The two men have also been suspended by the NYPD."

The scumbag cops are actually claiming this was consensual sex. Because if there's one time when someone can give meaningful consent, it's definitely when they've been arrested and handcuffed.

Also, they are smearing the victim by dragging her social media posts out and claiming she isn't "acting like a victim" because she's posting "provocative selfies" etc.

It all just makes you wonder why more women don't report their rapes or sexual assaults at the time, right?

Otherwise there would have been a charge of resisting arrest.

... and if she concented to being handcuffed who is to say the cops didn't think it was part of a sexual fantasy?

Whichever way you look at it, there's no legitimate reason for police to be having sex in the back of their car, and as they'rer in the position of power, they also shoulder the responsibility.

Right.

Also, apparently what complicates this somewhat is New York doesn't have a specific law against cops having sex with people in their custody. Which is insane. There is a law against corrections officers having sex with inmates, but nothing about cops and arrestees.
What these officers did should be considered rape no matter the circumstances, but under New York state law, it isn't.

The lack of a law against having sex with arrestees doesn't mean they are allowed to rape arrestees...

No, I absolutely am not confusing sex with rape. I am saying that it's impossible for anyone who's in police custody to give meaningful consent to sex with the officer(s) who arrested them (or any officer, for that matter). Therefore, all sex that police officers have with arrestees should be considered rape.

I was confused by your statement:

"What these officers did should be considered rape no matter the circumstances, but under New York state law, it isn't."

It sounded to me that you were saying that under New York state law, it cannot be considered rape...

No, what I meant was that it wasn't automatically considered rape because she was the arrestee and they were the arresting officers.

The phrases " officer sex with an arrestee" and "officer rape of an arrestee" should be synonymous in the law, just as they are in reality.
